What running guards in West Virginia actually involves

The Secretary of State is the regulator

West Virginia licenses security guard businesses through the Secretary of State’s Licensing Division under Chapter 30, Article 18 of the state code. Not the State Police, not a board: the same office that registers your corporation also licenses your guard firm.

Firm license versus individual license

If you work on your own, under your own name, you need an individual security guard license. The moment you employ anyone, or let anyone perform guard services under your name, you need a security guard firm license. Combined private investigator and security guard licenses also exist.

Every employee is checked against the same standard

Officers working under a firm license must meet the same eligibility rules as an individual licensee, minus the one-year experience requirement, and must authorize the Secretary of State to review their criminal records. A firm may not let anyone who falls short work a post.

Photos and fingerprints on file, in the state

Section 30-18-7 requires the firm to keep a recent full-face photograph and a complete set of fingerprints for every officer at its central business location in West Virginia, and to release them to the Secretary of State on request. An out-of-state office does not satisfy that.

Training is the firm’s job

The statute makes the license holder responsible for supervising every officer and providing the education and training reasonably necessary to comply. We found no state-set hour count in Article 18, which means your own training record is the evidence if anyone asks.

No subcontracting to unlicensed firms

Licensees may not transfer a license or contract or subcontract guard work to an unlicensed person or firm. If you cover a big contract with help from another company, check its West Virginia license first.

Energy, chemicals and industrial sites

Chemical plants in the Kanawha Valley, natural gas and pipeline infrastructure and the remaining coal operations put officers on large, remote properties where a patrol scanned at each checkpoint is the only proof the round was walked.

Hospitals, universities and the Eastern Panhandle

Medical centers in Morgantown, Charleston and Huntington, the state’s university campuses, and the distribution and federal facilities near the I-81 corridor round out the market. Posts are spread out, so supervisors spend much of their shift driving between them.

Do security guards in West Virginia need their own license? +

Only if they work on their own account. A guard employed by a licensed firm works under the firm license, but must meet the individual eligibility rules (except the one-year experience requirement) and authorize the Secretary of State to review their records, and the firm keeps their photo and fingerprints on file in the state. Confirm current forms with the Secretary of State’s Licensing Division.

How often does a West Virginia guard license renew? +

Every two years. Under W. Va. Code 30-18-9 a license is in effect for two years from issue and renews for two years with the fee and a current surety bond or proof of liability insurance. Does West Virginia state overtime apply to us? +

West Virginia requires time and a half after 40 hours in a workweek, but the Division of Labor says the state rule does not apply when 80% or more of an employer’s workforce is covered by the federal FLSA, which also uses 40 hours a week.
